THE CONTRACT

Waiver & Release:

These waiver and release acknowledgements form part of your agreement with So-Fit. Your agreement with us is made up of your payment, the terms and conditions, and these waiver and release acknowledgements. These documents together form a legal agreement between us, so please make sure you read carefully prior to signing/accepting.


Because physical exercise can be strenuous and subject to risk of serious injury, we urge you to obtain a physical examination from a doctor before using any exercise equipment or participating in exercise activity. You agree that by participating in physical exercise or training activities, you do so entirely at your own risk. Any recommendation for changes in diet including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility and you should consult a physician prior to undergoing any dietary or food supplement changes.


You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness or death. 


We are also not responsible for any loss of your personal property.


You grant permission to So-Fit MCR LTD  to use your image (photographs and/or video) for use in all media public relations If in the event you wish to not be used in media publications, you must provide a written and signed consent prior to video recording or photographing. You also acknowledge that you are 18 years of age or older and competent to contract in your own name or the parent or legal guardian of the member.


You understand that you are free to address any specific questions regarding this contract and its contents, and you agree that your failure to do so will be interpreted as a free and knowledgeable acceptance of this contract and its contents. You fully understand that this agreement is a release of liability. You expressly agree to release and discharge So-Fit MCR LTD from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring in a legal action against So-Fit MCR LTD for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release of liability shall remain in full force and effect and the offending provision or provisions severed here from. By signing this release, you acknowledge that you understand its content and that this release cannot be modified orally.


Terms and Conditions:

These terms and conditions form part of your agreement with So-Fit. Your agreement with us is made up of your payment, these terms and conditions, and the waiver and release. These documents together form a legal agreement between us, so please make sure you read carefully prior to signing/accepting.

Payments/Refunds/Exchanges:


Program purchases and scheduling can be made through your coach. 

•All payments must be made in full prior to any sessions being undertaken. Payments can be made via cash or Bank Transfer/Standing Order.


•All payments are final and cannot be returned to the original form of payment. A coach will not begin any program session without receiving full payment for the program from the member. If a member purchases a program and has not completed any sessions, the member can then use the dollar amount towards a future program purchase.


•There are no returns/refunds/exchanges/transfers for any clients who have already completed more than 1 session of their program. In the event that a member has already completed 1 or more sessions of their program and must cancel due to schedule conflicts/injuries/personal circumstance, the dollar amount of the remaining sessions will be credited to a future program session.

Any requests for refunds that are of special circumstance are at the discretion of the coach assigned to you.


Holidays & Cover:

If your coach is going on holiday, your coach will arrange your sessions to be done before they go away so you do not miss any sessions during that month. If this is not possible, after a discussion with client and coach, another coach will step in and cover for that personal training session.

When the client is due to go on holiday, 3 months notice is required to pre-plan and prepare to cover those sessions before the client goes away to make sure the client feels their best before they go away & so client doesn't loose sessions. 


Payment stays the same on the standing order as sessions are never cancelled, always rearranged.


Session Cancellations:

If your coach fails to give you 12 hours prior notice of any cancellation, you will be entitled to 1 extra session, in addition to the session the coach missed. 


We require a minimum of 24 hours prior notice of any cancellation of any session. This can be made directly through your coach. If you do not provide a minimum of 24 hours prior notice, you may lose that session and no refund/reschedule will be made to you.


Lateness:

The Coach and member should both be on time and prepared for the session.


 If your coach is more than 10 minutes late for your session, you will be entitled to a complimentary session, along with any remaining time you still have for that session. If you are late for your session, your session will be reduced with that time. If you are more than 30 minutes late, your coach may choose to cancel the session and you will lose that session, in which case no refund/reschedule will be made.


Expiration and Extensions:

All program options have a 90 Day expiration date from the time of the first scheduled session, after which time any unused sessions will be lost and no refunds will be made. This is to ensure we deliver all your required sessions to enable you to achieve your goals. 


You may extend programs until the end of the calendar year of purchase if a pregnancy or serious illness/injury occurs. This extension must be approved and coordinated between the member and the coach. It is the client's responsibility to contact the coach when is the appropriate time to finish the programs.
